Weartwice - User Terms and Conditions

Effective Date – 1 October 2024

These Weartwice Platform Terms of Use (these "Terms of Use") tell you the rules for using the platform available at www.weartwice.com and through any Weartwice mobile application available from time to time (collectively, the "Platform"), as well as any information, content, or materials published on, or available via, the Platform (collectively, the "Content").

These Terms of Use govern and condition access to, and use of, the Platform and its Content by each visitor to this Platform ("you").

BY USING THE PLATFORM, YOU ACCEPT THESE TERMS OF USE

By accessing and continuing to use the Platform, you confirm that you accept these Terms of Use, and acknowledge and agree that these Terms of Use govern and condition your access to, and use of, the Platform and any Content.

You understand that these Terms of Use constitute a legally binding agreement between you and Weartwice.

If you are using the Platform as a business entity or on behalf of a business entity, you represent that you have the authority to legally bind that entity.

If you do not agree to be bound by these Terms of Use, you may not access or use the Platform or any Content and should cease to do so immediately.

WE MAY MAKE CHANGES TO THESE TERMS OF USE

We may amend these Terms of Use from time to time, with or without notice to you. The new version of these Terms of Use will be made available on this page. If you are an existing registered user, we may also notify you of any material update to these Terms of Use via email (for example, where we are legally required to do so).

Every time you wish to use the Platform, please check these Terms of Use to ensure that you understand the terms and conditions that apply to the Platform and its Content at that time.

WE MAY MAKE CHANGES TO THE PLATFORM

We may change the way the Platform operates and/or change any Content from time to time without notice to you. This could be, for example, to reflect changes to the features and functionalities of the Platform, the state of current technology, or market practice, applicable laws or regulations and/or our business priorities.

WE MAY SUSPEND OR WITHDRAW THE PLATFORM

We do not guarantee that the Platform and/or any Content will always be available free of charge or generally available. We may suspend or withdraw, or restrict the availability of, all or any part of the Platform for business and/or operational reasons.

YOUR PRIVACY

Please refer to our Privacy Policy to understand how we collect, process, and share your personal data in relation to your use of the Platform.

YOUR RIGHT TO USE THE PLATFORM AND THE CONTENT

Subject to your continued compliance with these Terms of Use, Weartwice grants you a personal, limited, non-transferable, non-exclusive, revocable right to use the Platform and the Content.

You may print off one (1) copy, and may download extracts, of any page(s) from the Platform for your personal use and you may draw the attention of others to Content available on the Platform. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the Content for commercial purposes without obtaining a license to do so from us.

Weartwice is the owner or the licensee of all rights (including intellectual property rights) in the Platform and any Content, including without limitation any designs, text, graphics, and the selection and arrangement thereof. The Platform and the Content are protected by copyright laws and treaties around the world. All such rights are reserved.

All trademarks, logos, trade dress, service names, and service marks ("Marks") displayed on the Platform are our property or the property of certain other third-parties. You are not permitted to use these Marks without our prior written consent.

RESTRICTIONS

When creating an Account or using the Site or Services, you agree you will not :

  • Do anything illegal, unethical, contrary to public security or that infringes our or someone else’s rights (like their privacy, confidential information or intellectual property)
  • Use any kind of external software tools (including but not limited to: bots, scraping programs, crawling programs, spiders) when registering on the Site and/or when using the Site and/or Services (including but not limited to: for the purpose of promoting Items, adding Items to favourite), unless such a use is authorised, offered or in any other way allowed by us
  • Use any external software tool that could disrupt the normal operation of the Site or Services or infect or damage another User’s computer.
  • Adapt, copy, edit, distribute or commercialise any content on the Site without our prior written consent.
  • Data mine, screen scrape, crawl, disassemble, decompile or reverse engineer any part of the Site.
  • Publish Content that praises, promotes, encourages or incites terrorism, racism, revisionism, xenophobia, homophobia, sexism, hate speech, discrimination, human trafficking, organized crime, illegal organizations, self-injury, suicide, torture, cruelty to animals, apology of war crimes, sexual exploitation of children and/or adults, cults or other unlawful Content.
  • Delete and re-list the same Item multiple times or multiple Items in bulk.
  • Collect, hold or disclose information you obtained illegally that relates to other Users, their Content or their actions on the Site, or any information appearing on our Site if it might affect the rights of other Users.

  • Promote other websites or companies via advertisements on our Site.

    • We will report any breach of the restrictions listed above to the relevant law enforcement authorities and will cooperate with those authorities by disclosing your identity to them.

ACCOUNT CREATION

Although you can browse the Platform as a guest, you will need to create an account (an "Account") in order to access certain features of the Platform. If you choose to register for an Account, you will have to provide certain information about yourself as prompted during the account registration process on the Platform.

PAID SERVICES (PROMOT)

Weartwice may, from time to time, offer paid services on the Platform ("Paid Service"). For example, you may choose to pay a fee to ensure that your Listing is featured more prominently in search results on the Platform.

LISTINGS

The Platform enables a user wishing to sell an item or service (the "Seller") to advertise such item (each a "Listing") to other users of the Platform. A user who is interested in such an item or service (the "Buyer") may then contact the Seller (via the Listing) to make an offer for such item.

UPLOADING CONTENT TO THE PLATFORM

Any content you upload to the Platform, including as part of a Listing, will be considered non-confidential and non-proprietary.

ACCURACY AND COMPLETENESS

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is managed by Weartwice but product specific information and images are provided by our sellers. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

COUNTERFEIT ITEMS

Weartwice is a platform that connects buyers and sellers, facilitating the sale of second-hand items. While we strive to maintain the integrity of our marketplace, we do not authenticate or verify the authenticity of the items listed by sellers. Therefore, Weartwice makes no guarantees or representations regarding the authenticity of any items sold on the platform.

By using our platform, you acknowledge and agree that Weartwice is not responsible for any counterfeit, fraudulent, or misrepresented items that may be listed or sold by users. Any claims or disputes regarding counterfeit items must be addressed as per the refund policy

We strongly encourage buyers to conduct their own due diligence before making a purchase and sellers to adhere to all relevant laws regarding the sale of authentic goods. If counterfeit items are identified, we reserve the right to remove such listings and take appropriate action against the seller, including but not limited to account suspension or termination.

ACCEPTABLE USE POLICY

Whenever you make use of a feature that allows you to upload content to the Platform, or to make contact with other users of the Platform, you must comply with the standards set out in our Acceptable Use Policy.

OUR LIABILITY TO YOU

We do not intend to exclude or limit in any way our liability to you where it would be unlawful to do so.

BREACH OF THESE TERMS OF USE

When we consider, in our sole opinion, that you are in breach of any part of these Terms of Use, we may take such action as we deem appropriate in our sole discretion, including without limitation suspending or withdrawing your right to use the Platform or its Content, closing your Account, and/or taking legal action against you.

TAKING CORRECTIVE ACTIONS

If we find out you’re doing something that’s against the rules described in these Terms or obviously unlawful, we might apply any of the corrective actions listed below :

  • Send you a warning message that you need to follow these Terms
  • Remove or automatically correct your Items in the Catalogue
  • Demote, hide or remove your Content from the Site
  • Restrict your Account by blocking your access to certain features (like limiting visibility of your Items to other Users)
  • Notify local authorities about your activity if there’s a threat to someone’s life or safety

BLOCKING YOUR ACCOUNT

We might block your Account temporarily or definitively if :

  • We took a corrective action listed above and you continue to repeatedly breach these Terms
  • You commit a serious breach of these Terms, meaning :
    • You provide us with incorrect, false or misleading information on your Account or fail to keep your information up to date
    • You don’t cooperate with us when we try to verify information you provide on your Account.
    • you abuse the Site’s functionalities
  • One of the scenarios described below: Suspicions identified by a Weartwice Wallet Provider or Payment Processor, or Issues with Transactions, Safety and legal concerns, Minors or Security threats occur
  • Restrict your Account by blocking your access to certain features (like limiting visibility of your Items to other Users)
  • Notify local authorities about your activity if there’s a threat to someone’s life or safety

And when we say we will “block” your Account, this means :

  • You won’t be able to use the Site except to contact our customer support team (Customer Support),
  • Your Items will be delisted from the Site and taken off from the Catalogue
  • We won’t refund you for any Seller Services you bought from us and may still be using
  • You can complete any pending Transactions and Payouts, but if your Account is blocked because of security or fraud concerns raised by a Weartwice Wallet Provider, because your Account has been compromised or because it is objectively necessary to protect the legitimate interests and rights of everyone involved in a Transaction the following consequences may occur :
    • Your pending Transactions might be cancelled and all the fees paid by the Buyers would be refunded to the Buyers, and/or
    • Your ability to make a Payout might be restricted.
    • you abuse the Site’s functionalities
  • We may reject your compensation claim (if the reason for blocking was because of your fraudulent or other unlawful activity and/or abusing our compensation policies)
  • We may prevent you from creating a new Account on the Site

BLOCKING YOUR ACCOUNT

If you come across any Content on the Platform that you believe to be illegal, please contact us immediately at support@weartwice.com with full details of the illegal Content

DISPUTE RESOLUTION

If a dispute arises between you and Weartwice, we strongly encourage you to first contact us directly to seek a resolution by emailing support@weartwice.com. We will review your complaint and do our best to address it.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Arab Emirates.
